ASA EXTEND IT'S DIGITAL REMIT
01 Sept 2010 - The UK's ASA (Advertising Standards Authority) has announced that its digital remit is to be extended to cover online marketing communications as the result of a long and carefully considered project that involved a wide cross-section of UK industry.
The extension comprises three main components: scope, sanctions and funding, and will be supported by a training and awareness programme to help website owners get their marketing communications in line with the requirements of the Code in time for 1 March 2011.

NEW ASA CODES COME INTO FORCE
01 Sept 2010 - The UK's ASA (Advertising Standards Authority) new Advertising Codes come into effect today. It is important that all those involved with producing advertisements and other marketing communications understand and comply with the revised CAP and BCAP Codes to avoid the reputational or commercial damage that could result from breaching the rules.

EU COMMISSION PLANS FURTHER HARMONISATION OF DATA PROTECTION LAW
19 July 2010 - EU Justice Minister Viviane Reding said that laws adopted by the European Union's 27 member states should be changed so that they are closer to each other and to EU privacy directives. Addressing the Article 29 Working Party comprising of EU Member Data Protection Watchdogs, Reding told the meeting that EU law on data protection was too fragmented.
"The internal market requires not only that personal data can flow freely from one Member State to another, but also that the fundamental rights of individuals are safeguarded," she said. "Provided that all data protection guarantees are in place and properly applied, personal data should freely circulate within the EU and, where necessary and appropriate, be transferred to third countries. This requires us to provide a level playing field for all economic operators in different Member States. This is currently not the case."

NEW ZEALAND TCF DRAFT CODE FOR MESSAGING OUT FOR CONSULTATION
17 June 2010 - TCF, the Telecommunications Carriers Forum released their Draft Code for Industry Consultation with a closing date of 30th July 2010. Enarpee have been working with a major messaging aggregator in the NZ and Australian Market to prepare a response document.

AUSTRALIAN REGULATOR ACMA ISSUES FORMAL WARNING ON SPAM
16 June 2010 - ACMA The Australian Communications and Media Authority has issued a formal warning to Notebooks R Us for breaching the Spam Act. Following an investigation the company was found to be in breach of the Spam Act 2003 for sending commercial electronic messages without consent of the recipients.
The Spam Act establishes that commercial electronic messages must be sent with the recipient’s consent, and that consent to receive such messages is considered to be withdrawn five business days after any request to unsubscribe or opt out. Under the Spam Act, potential penalties of up to AUD $1.1 million per day may be imposed by the Federal Court for repeat offenders.
